Alerts Online's Privacy Statement (v1.0 22nd January 2004)
www.alertsonline.net (the "Alerts Online System") is operated and run by Alerts Online Limited ("Alerts Online" "Our" "Us" "We") from the address set out below.
At Alerts Online, we take your privacy very seriously. We are committed to making all aspects of Alerts Services which affects your privacy. We recognise your need for the protection of your privacy and the personal information that you provide to us. Personal information is any information that may be used to identify you as an individual such as your name, your address or other contact information.
This Privacy Statement describes the information that we may ask you for and the ways in which we may use that information. It also tells you how you can check whether your information is accurate and how you can instruct us to delete your information from our records. We are notified with the Office of the Information Commissioner in accordance with the Data Protection Act 1998 (as amended) (the "DPA 1998") and comply with all existing UK data protection and privacy laws.
1.2 If you do not agree to this Privacy Statement, please do not use the Alerts Online System. From time to time, we will make changes to this Privacy Statement that will be posted on the Alerts Online System. If you do not agree to the changes, please do not use the Alerts Online System. If material changes are made to this Privacy Statement, we will notify you by placing a prominent notice on the Alerts Online System or by e-mailing you if you are registered with us.
Who Is Collecting Your Information?
Alerts Online Ltd
3.1 Alerts Online Ltd is the owner of the Alerts Online System. We are responsible for all the information you provide to the Alerts Online System (via any Channel). Alerts Online will have access to this information although it will restrict access to only those employees or third parties with a legitimate reason to access it in the course of providing the Alerts Services to you.
3.2 We do not release your information to third parties for direct marketing purposes without your express permission.
3.3 Your information may also be made available to the Publishers authorised by Alerts Online, although their use of your information will be restricted and only used in the course of maintaining and running the Alerts Services.
3.4 Publishers are the originators of the content which we deliver via the Alerts Services (in some cases, Alerts Online may be a Publisher as well). You will need to read and accept their terms and conditions and privacy policies before subscribing to their notification services.
Third Party Providers
3.5 The Alerts Services can be accessed through third party providers. For instance, you can manage your Alerts Online account through a third party portal or website. Before deciding to access your Alerts Online account in this way, you should read and agree to their terms and conditions and privacy policies before subscribing to their notification services.
3.6 As a result of accessing your Alerts Online account through a third party portal or website rather than using the Alerts Online System, the information you provide is only used by Alerts Online for the purpose of providing the Alerts Services to you and the information should not be used or stored by that third party portal or website owner without your express permission.
3.7 There may be other intermediaries (of which a third party provider is one) through whose websites you may access your Alerts Online account. When doing so you should read and agree to their terms and conditions and privacy policies before subscribing to their notification services.
3.8 As a result of accessing your Alerts Online account through an intermediary rather than using the Alerts Online System, the information you provide is only used by Alerts Online for the purpose of providing the Alerts Services to you and the information should not be used or stored by that intermediary without your express permission.
What Information Do We Collect?
4.1 To use the Alerts Services, you must provide information such as your name and contact details. Alerts Online will make it clear what information you are required to provide and what information is optional. Where you do not provide optional information, you may not be able to access all the Alerts Services. For example, without providing a home address you will not be able to make credit card payments for delivery of messages to you.
4.2 We store a copy of all messages that are delivered through us to you (and from you to other recipients where you are the originator). This is for audit purposes. This is to allow you to see what messages have been delivered for your Alerts Online account and for us to store as long as necessary.
4.3 By using the Alerts Services, you agree to allow Alerts Online to store a copy of all messages delivered through the Alerts Services including the time and date of sending, the address used to deliver the message and the success or failure of that message (messages include receipts as well). We will also store a range of technical information to allow us to identify any problems with the service.
4.4 For the duration of your use of the Alerts Services, we will store certain pieces of information about your connection, your activity on the Alerts Online System, your computer hardware and software. This may include your IP address, browser type and version number, operating system type and version number, domain name, referring website address and search parameters used to find the Alerts Online System. This information is used for the operation of the Alerts Online System, to maintain the quality of the Alerts Services and to provide statistical information on the Alerts Online System to help identify improvements and enhancements.
4.5 Alerts Online also collects information about how you use the Alerts Online System such as which pages you visit, the order in which you visit them and which Alerts Services you register for and use. This helps us ensure that the processes that you have to go through are as easy as possible and to help identify any user experience issues.
Mandatory Or Optional Information
4.6 Not all information is mandatory and where information is not mandatory; it will say so on the Alerts Online System.
4.7 Any optional information you provide will be protected to the same standard as the mandatory information you provide. Some Alerts Services do require some of the optional information to be provided before the Alerts Service can be used. For example, if you want to receive Alerts via SMS, then you will need to provide certain information such as your mobile telephone number and maybe the name of your operator.
4.8 Some of the publishers will provide us with information about you in the course of delivering the Alerts Services. For example, a government department will provide the credential identifier for your Government Gateway account so that we can add it to your Alerts Online account. This will allow you to log in with your Government Gateway user id and password on the Alerts Online System in the future.
4.9 If you choose to associate another credential provider with your Alerts Online account (such as .Net Passport) then we would store the appropriate identifier as well.
4.10 We may store profile information about you, such as your Alerts Online System preferences (such as language, colour schemes, and accessibility settings). We may also use web beacons to show how many visitors have clicked on links or graphics on the Alerts Online System.
How Is Your Information Used?
5.1 We collect your information for a number of reasons. The first is that the Alerts Online System is a messaging system and we need to be able to audit what messages were sent to whom and when via what Channels and addresses for legal reasons. The message content will only be disclosed to you, our employees, any third parties acting on behalf of Alerts Online to deliver the message and the Publisher of the content.
5.2 The second reason is to enable us to ensure we can identify Users of the Alerts Services for audit purposes in case messages sent or received are offensive or obscene or in any way breaches applicable law.
5.3 The information yo provide is used for audit purposes and for security purposes. Some of the Alerts Services can only be used with the provision of certain information; for example, an e-mail channel can only be set up with the provision of your e-mail address.
5.4 We will also use your information on an opt-in basis to:
- send you information about Alerts Online or products, features and other services which we think may be of interest to you;
- send you newsletters or promotional information;
- notify you about carefully selected third party products and services which we think may be of interest to you; and
- carry out market and statistical surveys.
5.5 We will also use your information to develop or promote complimentary products and services for visitors and Users of the Alerts Online System and to customise the services that we provide to you on the Alerts Online System.
5.6 We use certain information in a general context that does not personally identify you but still allows us to analyse usage trends concerning the Alerts Online System and to make improvements to the Alerts Online System in accordance with such usage trends.
5.7 We may also provide aggregated (anonymous) statistics about the Alerts Online System's visitors, Users, sales patterns, online traffic patterns and related information to reputable third parties, but these statistics will not include any personally identifying information about you.
5.8 A reputable third party handles all credit card transactions securely. They will receive the information to verify and authorise your credit card data and to process your credit, debit and premium rate messaging payments.
5.9 Other than as required by law or as set out in this Privacy Statement, we will not disclose information about you to any third party without your prior written consent.
5.10 We will not sell your information to third parties but may disclose it to our suppliers and our group of companies in order to operate the Alerts Online System. We may also, in the unlikely event that we undergo a re-organisation of Alerts Online or sell all or any part of Alerts Online, transfer the information to the new owner of Alerts Online if you are a registered User.
Information Relating To Children
6.1 We will not intentionally collect any information about visitors or Users to Alerts Online who are under thirteen years of age. Where appropriate, we specifically instruct children under thirteen not to submit information to the Alerts Online System unless a parent or legal guardian has contacted us directly on their behalf.
6.2 If a child has provided us with information, a parent or legal guardian of that child may contact us on the e-mail address or address listed below if they would like a copy of such information or the deletion of such information in accordance with the procedure set out below.
6.3 With regard to children, we adhere to the following principles:
(i) we recognise that children need to be treated differently from adults and that all communications directed at children, or likely to be of particular interest to children, must be age appropriate and must not exploit their credulity, lack of experience or sense of loyalty;
(ii) we agree that information must only be collected from children with the explicit and verifiable consent of the child's parent or legal guardian unless the child is aged thirteen years or over, the information collected is restricted to that necessary to enable the child to be sent further but limited and appropriate online communications and it is clear that the child understands what is involved;
(iii) we agree that information collected from children must not be disclosed or transferred to third parties without the explicit and verifiable consent of the child's parent or legal guardian;
(iv) we agree that information relating to other people (for example, parents) must not be collected from children; and
(v) we will ensure that the public display or distribution of information by children must not be possible without the explicit and verifiable consent of the child's parent or legal guardian. For this reason we will do our best to ensure that no identifiable information relating to children is displayed on the Alerts Online System.
Security Of Your Information
7.1 The importance of security for all personally identifiable information associated with our Users is of the utmost importance to us. We will take reasonable precautions to prevent the loss, misuse, or alteration of information that you give to us.
7.2 Where messages are sent to you, these are not secure outside of the Alerts Online System as many Channels are not deemed secure. E-mail and SMS, for instance, do not have built-in security. Therefore, any message content and the fact that messages have been sent to you cannot be guaranteed to be secure after they have left the Alerts Online System. This is not peculiar to Alerts Online and is the same for all e-mail and SMS and many other Channel types.
7.3 Our agents or third party contractors, who have access to your information, are required to keep that information confidential and are not permitted to use it for any purpose other than to carry out the provision of the Alerts Services which they are performing for us or as set out in this Privacy Statement.
7.4 We use Secure Socket Layer (SSL) to encrypt sensitive credit card data. SSL is an industry standard and is one of the best ways to ensure that Internet communications are not intercepted. We also use 128bit encryption. Access to our server is password protected and behind a secure firewall.
7.5 Our employees who contravene this Privacy Statement are subject to an internal disciplinary procedure and possible dismissal. We cannot accept responsibility for any loss of unauthorised access or loss of information that is beyond our reasonable control.
7.6 To prevent Internet fraud, you should remember to log-off from the Alerts Online System after a session. Web browsers allow you to clear any cache so that any username or password cannot be misused.
8.1 We use "cookies" on the Alerts Online System so that the information that you enter is retained when you are using the Alerts Services and to help us to tailor the Alerts Online System to match your interests and preferences better.
8.2 "Cookies" contain data that is stored by your web browser on your computer's hard drive, and so Alerts Online does not store this information.
8.4 If you decide to disable cookies, please note that if you visit other pages on the Alerts Online System, you will need to re-type any information previously entered.
8.5 If you have disabled cookies, your enjoyment of the Alerts Online System may be impaired and you may not be able to use certain services or facilities on the Alerts Online System.
9.1 During the course of your relationship with us, we may choose to communicate with you. To do so we may use one of the Channels that you have provided us or we may choose to write to you at an address that you have provided us. We will only communicate with you regarding your Alerts Online account and any potential issues or queries we have in the course of providing the Alerts Services. Any other communication, such as sending you information about other services that we provide, will be on a strictly opt in basis.
9.2 If you have not chosen to receive unsolicited communications as set out in our subscription page, we will not contact you by post, e-mail, telephone or fax for purposes unrelated to the provision of Alerts Services to you.
9.3 If you consent to our contacting you by post, telephone, e-mail, SMS and fax, you agree that this does not breach any of your rights under the Privacy and Electronic Communications (EC Directive) Regulations 2003.
9.4 If at any time you wish to not receive any further communications from us about Alerts Online or from our carefully selected third party providers, you may remove yourself from our mailing lists by amending your preferences on the Alerts Online System or by contacting the portal or website where you originally subscribed to the Alerts Services.
Links To Third Party Portals or Websites
10.1 The Alerts Online System may contain links to third party portals or websites. We are not responsible for the privacy practices or content of such portals or websites.
Transfer Of Information Outside The European Economic Area
11.1 We may transfer our information to other countries outside the European Economic Area (EEA). For example, our web servers or our suppliers may be located outside the EEA.
11.2 You should be aware that some of these countries might have data protection laws that are equivalent to the DPA 1998 but some may not. We will take reasonable steps to protect your information as set out in the DPA 1998.
11.3 You hereby consent that our third party suppliers and we shall be permitted to process and to transfer your information including sensitive personal data (as defined in the DPA 1998) to a person outside the EEA in connection with your use of the Alerts Online System.
11.4 We will not transfer your information unless that person agrees to protect your information and only to use it in accordance with our instructions.
Access To Your Information
12.1 If you have given us information about yourself and would like copies of that information, or if you would like us to correct any factual inaccuracies in that information, or if you would like that information deleted from our records, then please write to us at the address set out below enclosing a cheque for £10.00 made payable to Alerts Online Ltd. We will respond to all such requests in accordance with the DPA 1998.
12.2 We cannot guarantee to delete your information from our records for audit purposes and for legal reasons. We will functionally delete your information, it will then only be used for audit purposes, and where we are legally obliged to share such information in accordance with law.
Monitoring And/Or Recording Your Communications
13.1 Telephone calls and e-mails to us may be monitored by individuals other than the original recipient in accordance with UK law for legitimate business reasons, security reasons, training, and quality control reasons.
